Ex-Parte Orders

Did you know that someone can go to court, make statements about you that may be allegations and you can lose your rights?

An Ex-Parte order is one that is made without notice and not requiring the attendance of the other party. 

The challenge with ex-parte orders is two-fold. Firstly, some people do not respect the court system and use it for personal gain, often in anger, without thinking through the repercussions for the other party or children that may be involved. 

Secondly, if there is an ex-parte order made against you that effects your rights, it could take months to get a court date to set it aside. This could result in months not seeing your children, not being permitted to live in your house, being without financial resources or other penalty. 

It is a cautionary tale. Keep the lines of communication open, secure an advocate as soon as possible after separation and negotiate to help minimize the other party going behind your back and effecting your rights.
